FIVE YEAR (LED) and ONE YEAR (CFL, Incandescent, Metal Halide) WARRANTIES

 


 

Solid State Lighting (LED) Warranty

 

 

Pathway Lighting Products, Inc. (Pathway) warrants the LED Engine and Driver of properly installed LED lighting products, to be free of defects in material and workmanship in normal use, for a period of five (5) years from the date of shipment from the factory. Pathway will repair or replace, at its option, any LED engine or driver that it determines to be defective. Documentation of use may be requested to validate hours. This limited warranty does not include installation or removal of fixtures.

 

 

 

Should any defects be found by Pathway upon its inspection of properly returned product, Pathway’s sole responsibility and liability under this warranty will be, at its option, to repair or replace the defective part or else make available a new replacement unit that will provide equal or better performance. The determination regarding the existence of defects affecting the warranty shall be made by Pathway and shall be final and binding.

 

 

 

The warranty is contingent on the proper installation, use and maintenance of the LED fixture. The fixture must be installed in the manner for which it is intended. The warranty will become null and void to any LED fixture that has not been timely paid for, is not installed and operated in accordance with the current edition of the NEC and Standards for safety of UL. The warranty will become null and void if the fixture has been operated in an ambient temperature that is higher than 45 degrees Celsius, has been subjected to a lightning strike, power surge, overvoltage condition, static electricity, subjected to abnormal stresses and operating conditions or has been operated without overvoltage and lightning protection devices in place.

 

 

 

All warranty requests are to be directed to Pathway’s Customer Service Department. A purchase order for replacement parts will be required. If deemed necessary the customer service representative will issue a Return Goods Authorization (RGA) number which must be included on both the packing slip of the component being returned and on the outside of the box. Please include your name and contact information -- including your email address -- on the packing slip. The product must be packaged carefully and shipped freight prepaid. Please obtain a proof-of-delivery to ensure the material is received. The customer is responsible for all shipping charges. If returned material is found to be defective, Pathway will issue an offsetting credit for the cost of the replacement parts and the associated shipping charges for them.

 

 

 

All LED Modules determined to be covered by this warranty, will be repaired or replaced at no charge to the customer, however, no labor costs will be covered for the removal or installation of any components or fixtures. The warranty does not cover modifications, repairs, replacements, the related labor or material costs that may be necessary to facilities or third-party products in connection with either removal or repair of any Pathway LED product under warranty. Normal wear and tear of the fixture is not covered under this warranty. Under no circumstances shall the warranty on any LED product exceed five years.

 

IN NO EVENT SHALL PATHWAY BE LIABLE TO BUYER, OR TO ANY THIRD PARTY, UNDER ANY THEORY (INCLUDING BUT NOT LIMITED TO UNDER CONTRACT, TORT, PRODUCT LIABILITY, STATUTE, COMMON LAW, OR ANY OTHER BASIS) FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES OF ANY NATURE, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, BUSINESS INTERRUPTION, REMOVAL AND/OR REINSTALLATION COSTS, REPROCUREMENT COSTS, OVERHEAD, DAMAGE TO REPUTATION, AND LOSS OF CUSTOMERS, EVEN IF PATHWAY HAS BEEN ADVISED OF THE POSSIBLITY OF SUCH DAMAGES. 

 

THE FOREGOING IS THE SOLE AND EXCLUSIVE WARRANTY, WHETHER EXPRESS, IMPLIED, OR CREATED BY OPERATION OF LAW, GIVEN BY PATHWAY TO PURCHASER OR ANY THIRD PARTY IN CONNECTION WITH THE PRODUCTS AND SERVICES SOLD OR PROVIDED BY PATHWAY.  PATHWAY DISCLAIMS AND EXCLUDES ANY AND ALL OTHER WARRANTIES (INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, INFRINGEMENT, SUITABILITY, OR WITH RESPECT TO ANY LATENT DEFECTS), WHETHER ARISING BY STATUTE, REGULATION, RULE OR OTHERWISE, INCLUDING TO BUYER AND TO ANY PERSON TO WHOM BUYER SELLS OR DELIVERS THE PRODUCT.  IN ADDITION, PATHWAY SHALL NOT BE LIABLE FOR ANY WARRANTIES GRANTED BY ANY THIRD PARTIES, INCLUDING BUT NOT LIMITED TO ANY MANUFACTURERS OF COMPONENT PARTS.

 

 

 


 

ONE YEAR WARRANTY for Lighting Fixtures using Compact Fluorescent, Incandescent and Metal Halide lighting technologies

 

 

Pathway Lighting Products Inc. (Pathway), warrants Lighting Fixtures using Compact Fluorescent, Incandescent and Metal Halide lighting technologies, used in accordance with the instructions and specifications given by Pathway, to be free of defects in material and workmanship in normal use, for a period of one (1) year from the date of shipment from the factory.  Pathway will repair or replace, at its option, any component that it determines to be defective. This limited warranty does not include installation or removal of fixtures, or any costs or expenses incurred during the inspection, removal, repair, installation, or replacement of any fixtures or any components of such fixtures.
